SHELLMENT, S.L., owner of the website, hereinafter the OWNER, makes this document available to users in order to comply with the obligations set out in Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSICE), BOE No. 166, and to inform all users of the website of the terms of use.
Any person accessing this website assumes the role of user, undertaking to strictly observe and comply with the provisions set out herein, as well as any other applicable legal provision.
SHELLMENT, S.L. reserves the right to modify any information that may appear on the website, without any obligation to give prior notice or inform users of such changes, publication on the SHELLMENT, S.L. website being deemed sufficient.
This legal notice governs access to and use of the website. The contracting of the platform's services is governed by the General Terms and Conditions, which constitute a separate document and prevail over this legal notice in all matters relating to the contractual relationship between the parties.

2. Intellectual and industrial property rights
The website, including but not limited to its programming, editing, compilation and other elements necessary for its operation, the designs, logos, text and/or graphics, are the property of the OWNER or, where applicable, the OWNER holds a licence or express authorisation from the authors. All website content is duly protected by intellectual and industrial property regulations.
The OWNER grants the user a personal, non-exclusive, non-transferable and revocable licence, limited to viewing the content and to downloading or reproducing isolated copies for strictly private, non-commercial use, without altering the content or removing any authorship notices, trademarks or rights-reservation notes. Any other use, and in particular the reproduction, distribution, public communication, transformation, permanent storage, indexing or extraction, in whole or in part, for public or commercial purposes, requires the prior written authorisation of the OWNER. Indexing by search engines for the purpose of facilitating user access to the website is excepted, which the OWNER expressly authorises and may revoke at any time. Any use not previously authorised is considered a serious breach of the author's intellectual or industrial property rights.
The extraction or re-utilisation of the whole or of a substantial part, evaluated qualitatively or quantitatively, of the content of the databases accessible through the website is prohibited, as is the repeated and systematic extraction or re-utilisation of non-substantial parts, pursuant to articles 133 et seq. of the Consolidated Text of the Intellectual Property Law.
The OWNER expressly reserves, pursuant to article 67.2 of Royal Decree-Law 24/2021 of 2 November and article 4.3 of Directive (EU) 2019/790, the rights of reproduction and extraction of the website content for text and data mining purposes, including its use for the training, fine-tuning, validation or evaluation of artificial intelligence models or systems. This reservation is also made by machine-readable means, in accordance with the World Wide Web Consortium's TDM Reservation Protocol, through the file hosted on the server, the response headers and the website metadata, and may be modified by the OWNER at any time.
"SHELLMENT", its logo and the other distinctive signs appearing on the website are registered trademarks and signs used in the course of trade by the OWNER, corresponding to its company name and its domain name. Their use without prior written authorisation is prohibited, including their use as a domain name, meta tag, advertising keyword or social media identifier, as well as any use likely to cause confusion about the business origin or to suggest affiliation, sponsorship or recommendation, without prejudice to the actions available to the OWNER under trademark and, where applicable, unfair competition legislation.
Designs, logos, text and/or graphics not belonging to the OWNER that may appear on the website belong to their respective owners, who are themselves responsible for any dispute that may arise in respect thereof.
The OWNER authorises links redirecting to the homepage or to specific content of the website, provided they are made as simple links, without reproduction of the content, without framing techniques and without statements likely to mislead as to the existence of affiliation, sponsorship or recommendation. The OWNER may revoke this authorisation at any time.
The OWNER recognises the corresponding intellectual and industrial property rights in favour of their holders, and their mere mention or appearance on the website does not imply the existence of any rights or responsibility over them, nor any endorsement, sponsorship or recommendation by the OWNER.

3. Terms of use and user obligations
3.1 General obligations. The user undertakes not to use the website or its content for purposes or effects that are unlawful, contrary to this legal notice or harmful to the rights and interests of the OWNER or of third parties, nor in any way that may damage, render useless, overload or deteriorate the website or prevent its normal use.
3.2 Prohibited uses. The following are expressly prohibited: (i) automated access to or extraction of content by means of robots, spiders, scrapers, crawlers or similar means, when carried out by circumventing the website's technical restrictions or in a way that affects its normal operation; (ii) the use of the content for the training, fine-tuning, validation or evaluation of artificial intelligence models or systems, in accordance with the reservation made in section 2; (iii) the circumvention of technological protection measures or access restrictions; (iv) presenting the content as one's own or incorporating it into third-party products or services; and (v) the creation of derivative works from the content.
3.3 Purpose of the content. The website content is exclusively for informational and disclosure purposes. It does not constitute legal, tax, financial or investment advice, nor an offer, invitation or recommendation to subscribe for, acquire or transfer any financial instrument, asset or participation whatsoever. Any figures, returns or estimates that may be shown are merely illustrative and do not guarantee future results. The contracting of the platform's services is governed by the General Terms and Conditions, which the user must expressly accept and which govern the rights and obligations arising from that relationship.
3.4 Breach. Breach of the provisions of this legal notice entitles the OWNER to suspend or deny access to the website and to bring the civil, criminal and administrative actions to which it is entitled.
4. Disclaimer
The OWNER accepts no liability arising from the information published on its website provided it has no actual knowledge that such information has been manipulated or introduced by a third party external to it or, if it does, it has acted diligently to remove the data or make access to it impossible.
Use of cookies
This website may use technical cookies (small information files that the server sends to the computer of the person accessing the page) to carry out certain functions considered essential for the correct functioning and display of the site. The cookies used are, in any case, temporary, with the sole purpose of making browsing more efficient, and disappear when the user's session ends. Under no circumstances do these cookies themselves provide personal data and they will not be used to collect such data.
Through the use of cookies it is also possible for the server hosting the website to recognise the browser used by the user in order to make browsing easier, allowing, for example, previously registered users to access areas, services, promotions or competitions reserved exclusively for them without having to register on each visit. They may also be used to measure audience, traffic parameters, monitor progress and number of entries, etc., in which case they are technically dispensable but beneficial to the user. Linking policy
The website may redirect to content from third-party websites. Since the OWNER cannot always control the content introduced by third parties on their respective websites, it accepts no liability for such content. In any case, it will immediately remove any content that could contravene national or international legislation, morality or public order, immediately removing the redirection to such website and bringing the content in question to the attention of the competent authorities.
The OWNER is not responsible for the information and content stored, including but not limited to, in forums, chats, blog generators, comments, social networks or any other medium that allows third parties to publish content independently on the OWNER's website. However, and in compliance with articles 11 and 16 of the LSSICE, it makes itself available to all users, authorities and security forces, actively collaborating in the removal or, where appropriate, blocking of all content that may affect or contravene national or international legislation, third-party rights, or morality and public order. If the user considers that there is any content on the website that could be classified as such, please notify the website administrator immediately.
This website has been reviewed and tested to work correctly. In principle, correct operation can be guaranteed 365 days a year, 24 hours a day. However, the OWNER does not rule out the possibility of certain programming errors, or the occurrence of force majeure, natural disasters, strikes or similar circumstances that make access to the website impossible.
IP addresses
The website servers may automatically detect the IP address and domain name used by the user. An IP address is a number automatically assigned to a computer when it connects to the Internet. All this information is recorded in a server activity file that allows the subsequent processing of the data in order to obtain purely statistical measurements that make it possible to know the number of page impressions, the number of visits made to the web servers, the order of visits, the access point, etc.
5. Applicable law and jurisdiction
For the resolution of all disputes or issues related to this website or the activities carried out on it, Spanish law shall apply. Where the user is not a consumer, the parties expressly submit to the Courts and Tribunals of Madrid, waiving any other jurisdiction that may correspond to them. For users who hold the status of consumer, the mandatorily applicable jurisdiction shall be competent.
